These Terms and Conditions ("Agreement") govern your use of the Carole Spilberg Designs website and your purchase of jewelry from our studio. By accessing this website or placing an order, you acknowledge that you have read, understood, and agree to be bound by all terms outlined below. If you do not agree to these terms, please do not use this website or purchase our products. 1. WEBSITE USE AND INTELLECTUAL PROPERTY 1.1 Limited License You are granted a limited, non-exclusive license to access and use this website for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or use any images, product descriptions, designs, or intellectual property on this website without prior written consent from Carole Spilberg Designs. 1.2 Prohibited Actions You agree not to: Copy product images or descriptions for commercial resale or promotional use Scrape or systematically collect data from this website Use this site in any way that violates applicable laws or infringes on others' rights Engage in any fraudulent, deceptive, or unlawful activity 2. PRODUCTS AND DESCRIPTIONS 2.1 Product Accuracy We make every effort to accurately describe and photograph our jewelry on this website. However, due to variations in photography lighting, monitor displays, and the handmade nature of each piece, actual colors and textures may vary slightly from images shown. 2.2 Handmade Variability All Carole Spilberg Designs jewelry is handcrafted. Due to the artisanal nature of our production process, no two pieces are exactly identical. Natural variations in materials, texture, and color are inherent to handmade jewelry and are not considered defects. 2.3 Availability All products listed on our website are subject to availability. We reserve the right to limit quantities, decline orders, or discontinue products at any time. If an item is unavailable after you place an order, we will notify you immediately and offer alternative options or a full refund. 3. PRICING, PAYMENT, AND ORDERS 3.1 Pricing All prices displayed on our website are in US dollars and are subject to change without notice. Prices are not binding until you place an order and we confirm acceptance. 3.2 Payment Methods We accept payment via credit card, debit card, PayPal, and other payment methods displayed at checkout. Payment must be made in full at the time of purchase. 3.3 Sales Tax Applicable sales tax will be calculated and added to your order based on your shipping address. Florida customers will be charged Florida state sales tax (6%) plus any applicable local taxes. 3.4 Order Acceptance Placing an order does not constitute an accepted sale. We reserve the right to accept or reject any order at our sole discretion. An order is only considered accepted when we confirm it via email with an order confirmation and/or invoice. Any order that appears fraudulent will be declined. 4. SHIPPING AND DELIVERY 4.1 Eligible Shipping Locations We ship to all addresses within the continental United States only. We do not ship to Hawaii, Alaska, US territories, or international addresses. If you attempt to order to a non-eligible address, your order will be cancelled and a full refund issued. 4.2 Processing and Shipping Orders typically ship within 3-5 business days. Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by carriers. 4.3 Shipping Costs and Responsibility Shipping costs will be calculated at checkout and are non-refundable once an order is placed. Orders under $35 USD are charged a flat rate of $7 USD shipping. Orders above this amount are shipped free. All orders are shipped via USPS Ground Advantage by default. Upgraded shipping is available via USPS Priority or USPS Priority Express for an additional fee at your expense. Once your order is shipped, risk of loss and damage passes to you, the customer. 4.4 Delivery Confirmation We will provide you with tracking information via email. Responsibility for delivery passes to you upon shipment. If a package is damaged upon delivery or goes missing, you must notify us within 48 hours of delivery (or expected delivery date) with photographic evidence. We will work with you to file a claim with the carrier or arrange replacement, provided the claim is filed promptly. 4.5 Shipping Address Responsibility It is your responsibility to provide a correct shipping address. We are not responsible for packages shipped to incorrect addresses provided by you. 5. RETURNS AND REFUNDS 5.1 Ready-Made Jewelry Returns Jewelry may be returned within 14 days of delivery if the item is unworn, unwashed, and in original condition with all tags attached. The item must be returned via insured mail with tracking. Once received and inspected and approved, a refund will be issued within 7-10 business days. 5.2 Non-Returnable Items The following items are not returnable: Items that have been worn, washed, or altered Clearance or final-sale items (if marked as such) Gifted items delivered to the wrong address, or returned as undeliverable Items damaged by customer misuse 5.3 Return Shipping Return shipping costs are the customer's responsibility. We recommend insured shipping. Once your return is received, inspected, and approved, a refund will be issued within 7-10 business days. Refunds are issued to the original payment method. 5.4 Warranty and Quality We stand behind the quality of our handcrafted jewelry. If a piece arrives damaged due to our error or defective workmanship, contact us within 48 hours of delivery with photographic evidence. We will repair or replace the piece at no charge. This warranty does not cover normal wear, damage from customer misuse, or damage caused by improper care. 6. CARE AND MAINTENANCE 6.1 Care Instructions Proper care extends the life of your jewelry. We provide care instructions with each purchase. Customers are responsible for following these instructions and maintaining their jewelry appropriately. 6.2 Repairs For repairs needed due to normal wear or damage after purchase, we offer repair services at reasonable rates. Contact us for a quote. Repairs by jewelers other than Carole Spilberg Designs may affect future warranty coverage. 7. INTELLECTUAL PROPERTY RIGHTS 7.1 Our Design Rights All designs, images, and creative content on this website remain the intellectual property of Carole Spilberg Designs. You may not reproduce, distribute, or use these designs for commercial purposes without written permission. 8. LIMITATION OF LIABILITY 8.1 Disclaimer TO THE FULLEST EXTENT PERMITTED BY LAW, CAROLE SPILBERG DESIGNS IS PROVIDED "AS IS" AND "AS AVAILABLE." If for any reason you are not completely satisfied with your purchase, we are happy to work with you to make it right. RETURN POLICY Return Window We accept returns within 14 days of delivery. This timeline begins from the day your package is delivered to you, as confirmed by tracking information. We are not responsible for items lost or damaged during return shipping. Lost Packages If your package shows as delivered but you have not received it, please contact us within 48 hours of the expected delivery date. We will work with the carrier to locate your package or file a claim.
